The High Court has issued conservatory orders to Deputy President Rigathi Gachagua’s allies blocking the DCI from arresting them and subsequent prosecution by the ODPP over allegations of financing the June 25th Gen Z protests.
High Court Judge, Justice Lawrence Mugambi issued the order following an application filed by Ngunjiri Wambugu, George Theuri and Pius Munene.
According to the Judge, “Pending the hearing and determination of the application, the court issued a conservatory order restraining the DCI and ODPP from arresting, detaining or prosecuting them from the allegations raised in this petition,”
The Judge in certifying the matter as urgent directed the application by the three served on the DCI, DPP and the Attorney General by close of business Today.
The petitioners faulted the state for going to the extent of desiring to prosecute DP Gachagua’s allies on what they call “trumped up charges”.
“It was the president who was on record addressing the public and informing Kenyans on investigations conducted regarding the financiers,” argued the petitioners.
The three said the probe was able to establish who these people were.
“The communication of the president whose word is binding on the final findings of the investigative authorities vindicates us of any wrongdoing in the allegations,” said Ngunjiri.
They said their names were not mentioned in the statement.
The case will be mentioned on October 15.
