Betika’s Head of Technology charged by a Nairobi court for stealing Ksh 11m from the firm

The Head of technology at a leading local betting firm Betika was on Thursday charged with defrauding the company a sum of Ksh 11 million while working at the firm.

Fred Gitonga Njagi who was arraigned at the Milimani Law Courts Nairobi on Thursday morning is alleged to have committed the offence of stealing by a servant between January and February 2022.

“You are charged that on diverse dates between 13 January 2022 to 3 February 2022 at an unknown place within the republic of Kenya being a servant of Shop and Deliver (Betika) jointly with others, not before court stole Kshs 11.007.393/-the property of Shop and Deliver (Betika), which came into your possession by virtue of your employment as head of technology” read the charge sheet in part.

Fred who was represented by Lawyer Henry Kurauka pleaded with the court to defer the plea for ten days to allow him to seek orders from the high court an application that was dismissed by the court.

Kurauka had indicated to the court that the rights of the accused person had been violated during his arrest and wanted to file an application at the constitutional court over the same.

The prosecution through state counsel Ann Munyua objected to the application and asked the court to order the accused to plead to the charges.

“There is no prejudice to the accused if he pleads to the charges, the issue of the violation of his rights can only be addressed by the high court,” said Munyua.

Fred pleaded not guilty and was granted cash bail of Ksh2 million with an alternative bond of Ksh5 million.
